What This Page Is

This page summarizes the warranty coverage that typically applies to the equipment, parts, and services Bay Equipment Company, doing business as Bay Equipment Co. ("Bay Equipment," "we," "us," or "our"), provides, and explains how to make a claim.

This page is a summary for your information. It is not a warranty. The warranty that applies to your transaction is stated in your invoice, bill of sale, service order, or Rental Agreement. If anything on this page differs from those documents, the documents control. See Sections 5, 8, and 16 of our Terms and Conditions.

1. New Equipment, Attachments, and Parts

New equipment, attachments, and parts we sell are covered by the manufacturer's warranty, on the manufacturer's terms. Bay Equipment does not add a warranty of its own unless one is printed on your invoice or bill of sale.

  • The manufacturer's warranty period normally runs from the in-service date or the purchase date shown on your invoice. We record the serial number and the warranty term on the invoice so both of us have it.
  • Some manufacturers require you to register the product to activate coverage. If your paperwork says to register, do it promptly; we cannot do it for you.
  • Bay Equipment is an authorized warranty service center for multiple brands, contact us for the current list. For those brands, bring the unit to us and we will perform covered warranty repairs directly with the manufacturer. For other brands, we will help you identify the nearest authorized service center and give you the purchase records the manufacturer will ask for.
  • The manufacturer, not Bay Equipment, decides whether a failure is covered.

2. Used and Previously Rented Equipment

Unless we expressly provide a written warranty in the sale documents, used, pre-owned, and previously rented equipment is sold "AS IS, WHERE IS," with all faults, and without any warranty of any kind.

  • Hour meter and odometer readings, condition descriptions, service history, and remaining component life are approximate, unverified, and not warranted.
  • We strongly encourage you to inspect used equipment in person, or to have a qualified technician of your choosing inspect it, before you buy.
  • If any manufacturer warranty remains on a used unit, whether it transfers to you is a matter between you and the manufacturer. We will give you the serial number and in-service date we have on file to help you ask.

3. Rental Equipment

A rental is not a sale, and rented equipment is provided as is, without any warranty. What happens if a rented unit breaks down is set out in Section 5 of your Rental Agreement, and in summary it is this:

  • We inspect every unit before it goes out. Under the Rental Agreement you confirm that each unit is complete and in good working order when you accept it or we deliver it, so look it over and tell us right away if something is wrong.
  • If a unit breaks down, malfunctions, or proves defective during the rental, stop using it immediately and call the branch at (757) 249-1111, then return the unit to us or arrange its return with us.
  • Provided the problem was not caused by misuse, neglect, or a breach of the Rental Agreement, we will, at our option, repair the unit, provide a comparable replacement, or refund the unused portion of the rent and end the rental. These are the only remedies for a malfunction.
  • Rent is not reduced for weekends, holidays, weather, time in transit, or other periods when a unit is not in use.
  • Damage or failure caused by misuse, overloading, running without fuel or oil, operating contrary to the manufacturer's manual, or neglect is billed to the renter.
  • We are not responsible for downtime, labor, project delay, or other consequential costs. The Rental Agreement controls.

4. Service and Repair Work: Limited Warranty on Labor

Bay Equipment warrants the workmanship of repair labor we perform for 60 days from the invoice date. Parts we install carry the manufacturer's warranty described in Section 1.

If a repair we performed fails within that period because of our workmanship, bring the unit back to the branch that did the work. We will diagnose it and, if the failure is covered, correct it at no charge for labor. If the failure is not covered, we will tell you before doing chargeable work.

This limited warranty does not cover:

  • Wear items such as blades, bits, belts, filters, hoses, tires, tracks, batteries, spark plugs, and cutting or grinding consumables;
  • Problems unrelated to the repair we performed;
  • Damage from continuing to operate the unit after a fault was apparent;
  • Work performed, or parts installed, by anyone other than Bay Equipment; or
  • Any condition listed in Section 6.

5. Parts Returns

Stock parts may be returned within 30 days of the invoice date if they are unused, uninstalled, in the original packaging, and accompanied by the invoice. Returns are subject to a 20% restocking fee. Refunds are issued to the original payment method or, for house accounts, as a credit to the account.

We cannot accept returns of:

  • Special-order parts;
  • Electrical and electronic components once installed;
  • Opened fluids, lubricants, or chemicals;
  • Hazardous materials, flammable liquids, or gases;
  • Custom-color or custom-cut materials; or
  • Items sold "as is."

If a part arrives damaged, defective, or is not what you ordered, contact us at (757) 249-1111 or info@bayequip.com as soon as you receive it and we will make it right.

6. What Is Not Covered

Whether the item is new, used, rented, or serviced, coverage does not extend to:

  • Normal wear and tear, and consumable items;
  • Damage from accident, misuse, abuse, neglect, overloading, or use for a purpose the equipment was not designed for;
  • Failure to perform the maintenance the manufacturer's manual requires, or use of the wrong fuel, lubricant, or fluid;
  • Improper storage, transport, or installation;
  • Unauthorized modification or repair;
  • Cosmetic conditions that do not affect operation;
  • Weather, flooding, fire, theft, or vandalism; or
  • Loss of use, downtime, labor, rental of substitute equipment, lost profits, or any other consequential cost.

7. How to Make a Claim

  1. Call the branch at (757) 249-1111 or email info@bayequip.com.
  2. Have your invoice or rental contract number, the serial number, the purchase or rental date, and a description of the problem. Photos or a short video of the fault help.
  3. We will respond within 2 business days and tell you the next step: a warranty repair with us, a referral to the manufacturer's service center, or an exchange or credit.
  4. If the unit has to come to a branch for inspection, you arrange and pay for inbound transport; if the claim is approved we return the unit at our cost.

8. Legal Notes

This page is provided for information and is not a written warranty. No employee or agent of Bay Equipment is authorized to make any warranty beyond what is stated in your invoice, bill of sale, service order, or Rental Agreement.

EXCEPT FOR THE LIMITED WARRANTY ON LABOR IN SECTION 4 AND ANY WARRANTY EXPRESSLY STATED IN YOUR SALE DOCUMENTS, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BAY EQUIPMENT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. YOUR EXCLUSIVE REMEDY UNDER ANY WARRANTY BAY EQUIPMENT PROVIDES IS REPAIR, REPLACEMENT, OR REFUND OF THE PRICE PAID, AT OUR OPTION. BAY EQUIPMENT IS NOT LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES.

Some states do not allow limitations on how long an implied warranty lasts or the exclusion of incidental or consequential damages, so the limitations above may not apply to you. This page gives you specific legal rights, and you may also have other rights that vary from state to state. This page and any warranty Bay Equipment provides are governed by the laws of the Commonwealth of Virginia.
